Ratification of the National Guards Amendment

Nach den verfassungsrechtlichen Vorschriften haben

das Repräsentantenhaus am 28. September 2024 (RE: H.J.Res. 2024-30 - National Guards Constitutional Amendment Resolution (House))
der U.S. Senate am 08. Oktober 2024 (RE: S.J.Res. 2024-030 - National Guards Constitutional Amendment Resolution (Senate))

beschlossen, den Bundesstaaten einen Verfassungszusatz zur Constitution of the United States zur Ratifizierung vorzulegen.

Der Text des Verfassungszusatzes lautet - nach übereinstimmendem Beschluss beider Kammern - wie folgt:

Amendment __ [National Guards maintained by the States]

(1) Das Recht der Bundesstaaten, zusätzlich zu den staatlichen Sicherheitsbehörden bewaffnete Verbände neben den Streitkräften der Vereinigten Staaten aufzustellen, wird gewährleistet. Die Angehörigen dieser Verbände sind auch auf die Verfassung der Vereinigten Staaten zu vereidigen.

(2) Dem Oberbefehlshaber der Streitkräfte der Vereinigten Staaten steht die Befugnis zu, die Verbände nach Absatz 1 in den Dienst der Vereinigten Staaten zu berufen, wenn dies nach seinem Urteil erforderlich ist, um die innere oder äußere Sicherheit der Vereinigten Staaten zu gewährleisten.

(3) Der Oberbefehlshaber der Streitkräfte der Vereinigten Staaten kann ferner die notwendigen Vorschriften erlassen, um eine einheitliche Organisation, Ausrüstung und Führung im Interesse der Vereinigten Staaten sicherzustellen und den Übergang von Soldaten von oder zu den Streitkräften der Vereinigten Staaten zu regeln.

(4) Der Kongress hat das Recht, die Ausübung der Befugnisse nach Absatz 2 und 3 durch Gesetz zu regulieren.

Gemäß Art. VII Sec. 3 Ssc. 2 und Amendment I ist nunmehr die Zustimmung der Bundesstaaten einzuholen, die durch die gesetzgebenden Körperschaften zu erteilen ist. Erforderlich ist die Zustimmung von 3/4 der Bundesstaaten und eine Wiederholung des Verfahrens ist ausgeschlossen.

Die Bundesstaaten werden aufgefordert, den Beschluss ihrer gesetzgebenden Körperschaft dem U.S. Congress mitzuteilen.

THE GOVERNOR OF THE STATE OF ASTORIA

CERTIFICATE OF RATIFICATION

Whereas, the Congress of the United States of Astor, the U.S. House of Representatives acting on the Twenty-eight day of September and the U.S. Senate acting on the Eight day of October of this year Two Thousand Twenty-Four, did propose an Amendment to the Constitution of the United States titled "National Guards Amendment", which was thereafter submitted to the Legislatures of the several States for ratification, in accordance with Article VII, Section 3 and Amendment I of the Constitution of the United States; and

Whereas, the Common Assembly of the State of Astoria, composed of the Assembly of Senators and the Assembly of Representatives, having been duly convened in their respective chambers and in full accordance with the Constitution of this State and all other applicable laws and procedures, considered the Amendment and

Whereas, on the Fourth day of November in the year Two Thousand Twenty-Four, the Assembly of Senators did pass a resolution ratifying the said Amendment by a majority vote, and the Assembly of Representatives likewise passed a resolution ratifying the same by a majority vote*;

Now, therefore, be it known that I, Kathleen T. Johnson, Governor of the State of Astoria, do hereby certify and proclaim that the State of Astoria has ratified the said proposed Amendment to the Constitution of the United States.

In witness thereof, I have hereunto set my hand at Fink House in the City of Greenville, this 05^th day of November in the year 2024.

THE LEGATE OF THE HIGH REPUBLIC OF SERENA

CERTIFICATE OF RATIFICATION

Whereas, the Congress of the United States of Astor, the U.S. House of Representatives acting on the Twenty-eight day of September and the U.S. Senate acting on the Eight day of October of this year Two Thousand Twenty-Four, did propose an Amendment to the Constitution of the United States titled "National Guards Amendment", which was thereafter submitted to the Legislatures of the several States for ratification, in accordance with Article VII, Section 3 and Amendment I of the Constitution of the United States; and

Whereas, the Grand Serenese Senate of the High Republic of Serena have been duly convened and in full accordance with the Constitution of this State and all other applicable laws and procedures, considered the Amendment and

Whereas, on the 16th day of November in the year Two Thousand Twenty-Four, the Grand Serenese Senate did pass a resolution ratifying the said Amendment by a majority vote;

Now, therefore, be it known that I, Javier Rodriguez, Legate of the High Republic of Serena, do hereby certify and proclaim that the High Republic of Serena has ratified the said proposed Amendment to the Constitution of the United States.
