IN THE HOUSE OF REPRESENTATIVES OF THE UNITED STATES

Mr. GLENWOOD of Alcantara introduced the following Joint Resolution.

A JOINT RESOLUTION

Proposing an amendment to the Constitution of the United States concerning the incapacity of the President of the United States.

Resolved by the Senate and House of Representatives of the United States of Astor in Congress assembled, that the following article is proposed as an amendment to the Constitution of the United States, which shall be valid to all intents and purposes as part of the Constitution when ratified by popular vote of three-fourths of the several States:

(1) Ist der Präsident aus gesundheitlichen Gründen wegen Amtsunfähigkeit vorübergehend oder dauerhaft an der Führung seiner Amtsgeschäfte gehindert, so gilt er als verhindert im Sinne von Article IV Section 2 und Amendment VIII dieser Verfassung.

(2) Soweit der Präsident nicht selbst das Vorliegen der Amtsunfähigkeit nach Absatz 1 dieses Verfassungszusatzes erklärt, kann diese festgestellt werden. Die Feststellung ist durch den Vizepräsidenten mit Zustimmung der Mehrheit derjenigen Personen zu treffen, die der Präsident zur regelmäßigen Mitwirkung an den Aufgaben der Exekutive berufen hat, insbesondere derjenigen, denen mit Zustimmung des Senats die Leitung einer obersten Bundesbehörde übertragen worden ist.

(3) Die Verhinderung wegen Amtsunfähigkeit endet, wenn der Präsident schriftlich seine Amtsfähigkeit erklärt. Widerspricht der Vizepräsident dieser Erklärung unverzüglich, so hat der Kongress unmittelbar zusammenzutreten und über den Widerspruch zu beraten. Die Amtsunfähigkeit gilt als beendet, wenn nicht beide Kammern des Kongresses mit Zweidrittelmehrheit feststellen, dass sie andauert. Sie gilt ferner als beendet, wenn auf Verlangen des Präsidenten der Oberste Gerichtshof entscheidet, dass der Kongress seine Entscheidung nach den Umständen des Einzelfalls unangemessen verzögert hat.

(4) Stellt der Präsident fest, dass der amtierende Vizepräsident aus gesundheitlichen Gründen wahrscheinlich dauerhaft amtsunfähig ist, soll er diese Frage dem Kongress vorlegen. Stellen beide Kammern des Kongresses mit Zweidrittelmehrheit fest, dass die Amtsunfähigkeit besteht, scheidet der Vizepräsident aus seinem Amt aus.

(5) Das in den Absätzen 2 und 3 festgelegte Verfahren findet entsprechende Anwendung, wenn die Amtsunfähigkeit eines Acting President in Ansehung dieses Amtes festzustellen ist. An die Stelle des Vizepräsidenten tritt in diesen Fällen derjenige Amtsträger der Exekutive, der als Nächstes zur Führung der Amtsgeschäfte berufen wäre.
